Walton v. Lake-Sumter State Coll. (Fla. App. Apr. 14, 2023)

Opinion affirming termination. Plaintiff, a former professor of anthropology at Lake-Sumter State College who had been awarded a continuing contract, appealed his termination after the College found that due to low demand for anthropology courses, he was teaching too many student success courses to meet his required workload. The court held that even though the College President should have recommended plaintiff’s “discontinuance” rather than his “termination” for cause, the “purported oversight is harmless” because the College (1) had the legal authority to modify curriculum and discontinue an academic discipline and (2) documented its decision adequately in the evidentiary proceedings.
