    U.S. Dep.’t of Education Notice of Information Collection on Gainful Employment/Financial Value Transparency Reporting Requirements (Feb. 21, 2024)

    U.S. Department of Education Notice of New Information Collection Request on Gainful Employment/Financial Value Transparency Reporting Requirements. The Department’s new Final Rule on Financial Value Transparency requires institutions “to report on the students who enroll in, complete, or withdraw from a gainful employment (GE) program or an eligible non-GE program in specified award years.” The Department estimates that the total number of annual burden hours will be 2,665,823. Comments are due on or before April 22, 2024.

This summary highlights the recent decision by Region 01 of the National Labor Relations Board (NLRB) that Dartmouth College’s men’s basketball team are employees eligible to unionize; the Department of Education’s allocation of $50 million to provide direct funding for technical and other tools in FAFSA assistance to help institutions process student records and deliver financial aid packages; and the latest update to the National College Attainment Network’s (NCAN) FAFSA tracker showing that only 16.3% of the high school class of 2024 has submitted a FAFSA, a 56.6% decrease compared to the 2023 academic year.

    U.S. Dep.’t of Education DCL on Title IV Eligibility for Direct Assessment Programs (Feb. 14, 2024)

    U.S. Department of Education Dear Colleague Letter (DCL) on Applying for Title IV Eligibility for Direct Assessment (Competency-Based) Programs. The letter addresses the process by which an institution may apply to use Title IV funds for a competency-based program that relies on direct assessment of competencies rather than clock or credit hours. Of note, the institution must “establish a methodology to reasonably equate each module in the direct assessment program to either credit hours or clock hours” and this methodology must be approved by an accrediting or State approval agency with direct assessment in its scope of recognition. The application must also address how the institution will determine whether the student is making satisfactory progress or has withdrawn or changed enrollment status.

    U.S. Dep.’t of Education Request for Information on Sexual Violence at Educational Institutions (Jan. 24, 2024)

    U.S. Department of Education Request for Information (RFI) on Sexual Violence at Educational Institutions. Pursuant to the Violence Against Women Act (VAWA) Reauthorization Act of 2022, the Department requests information to assist the Task Force on Sexual Violence in Education in its work to make recommendations to educational institutions on best practices for preventing and responding to sexual violence on campuses. The RFI lists seven questions of interest, including factors and best practices for institutions to consider in establishing sexual assault prevention and response teams and considerations for responding to sexual and dating violence. Comments are due by March 11, 2024.

    CFPB Report on College Banking and Credit Card Agreements (Dec. 19, 2023)

    Consumer Financial Protection Bureau (CFPB) Report to Congress on College Banking and Credit Card Agreements. The Report examines financial products, including deposit and prepaid accounts and credit cards, offered and marketed to students by institutions or affiliated entities and provided through agreements with third-party financial services providers. Noting that the institutions or affiliated entities marketing these financial products may have interests independent from those of their students, the Report identifies products and services that may be more expensive for students than other available options and itemizes by institution and financial service provider the arrangements that are most expensive to students and those that provide the largest payments by the provider to the institution or affiliated entity.
