SUMMARY:Yes We Can: Approaches to Post-Tenure Faculty Review
DESCRIPTION:CLE Workshop\n\nFall 2024 CLE Workshop: Sponsored Research and Technology Transfer\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nThe vast majority of tenured faculty members offer vital contributions throughout their careers to advance the teaching and research missions of their colleges and universities.  However\, addressing the performance and conduct issues posed by a small number of tenured faculty in a shared governance framework often requires a large-scale coordinated effort on the part of counsel\, provosts\, department chairs\, and a cadre of other institutional leaders.  The result is usually limited success in minimizing the legal and reputational risks posed by an underperforming or misbehaving faculty member – or worse— messy and public complaints\, litigation\, and internal cultural strife.  \n\n\n\nJoin us for a 90-minute webinar in which two expert NACUA member attorneys will discuss post-tenure faculty review\, including:  \n\n\n\n\n Legal developments over time that have impacted the institution of tenure that have both contributed to the challenge of problematic tenured faculty members and recently provided an opportunity to address this issue;\n\n\n\nCosts and benefits of instituting a post-tenure review policy or system that balances risk mitigation\, due process\, and respect for academic freedom;\n\n\n\nPractical considerations such as building internal stakeholder support;\n\n\n\nAnd employment legal implications including conducting defensible reviews\, unionized faculty\, and more. \n\n\n\n\nWho Should Attend?  \n\n\n\nThis webinar will be of particular interest to counsel who advise on faculty matters\, academic affairs\, employment law\, and institutional policy development and management\, as well as institutional colleagues in the Offices of the Provost\, Faculty Affairs\, and Academic Affairs. \n\n\n\n\n\nSpeakers\n\n\n\n\n\n\n\n\n\n\nProgram Schedule\n\n\n\nTimeSession Topic12:00 P.M. SUMMARY:Navigating the World of Affiliated Entities
DESCRIPTION:CLE Workshop\n\nFall 2024 CLE Workshop: Sponsored Research and Technology Transfer\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nAffiliated entities are part of the fabric of college and university operations.  Whether we are talking about alumni foundations\, athletic boosters\, or real estate partnerships\, colleges and universities often create affiliates to advance institutional mission while reducing risk exposure\, managing financing or tax issues\, and reducing operational barriers that might otherwise inhibit institutional goals.  Of course\, counsel must devote a great deal of thought to structuring these affiliates and managing the associated legal and practical challenges.  Join us for a 2-hour webinar in which two expert NACUA member attorneys will discuss:  \n\n\n\n\nReasons for creating affiliated entities; \n\n\n\nConsiderations in structuring affiliated entities\, including special governance considerations; \n\n\n\nExamples of where and how affiliates are used; \n\n\n\nLegal and operational challenges and risks;  \n\n\n\nUnique issues related to joint ventures\, research affiliates\, and traditional foundations;\n\n\n\nAnd more. \n\n\n\n\nWho Should Attend? This webinar will be of particular interest to counsel who advise on business and transactional issues\, University business officers\, and NACUA members employed by institutional affiliates. \n\n\n\n\n\nSpeakers\n\n\n\n\n\n\n\n\n\n\nProgram Schedule\n\n\n\nTimeSession Topic12:00 P.M. SUMMARY:At The Top of Your Feed:  Social Media Issues on Campus
DESCRIPTION:CLE Workshop\n\nFall 2024 CLE Workshop: Sponsored Research and Technology Transfer\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nStudents\, faculty\, and staff have long used social media to engage with one another and with the world outside of the institution. However\, the expanding reach and evolution of social media platforms has challenged the law – and campus counsel – to keep pace. One post can unleash severe ideological clashes among faculty\, students\, and the community in a contentious political climate. A new reel can give rise to an entire workstream focused on student-athletes’ ability to use social media for commercial purposes. A five-word Tweet can lead to a five-month legal saga with the growing world of influencers providing social media commentary as the institution grapples with sensitive issues. These are just some of the complex situations arising from social media at colleges and universities. Join us for this 2-hour webinar where presenters will explore legal developments related to social media issues\, including:  \n\n\n\n\nAdvice for developing and revising social media policies\,\n\n\n\nUpdates on recent case law in the social media space\, including guidance on distinguishing “on-campus” from “off-campus” speech and on addressing and/or disciplining social media behavior by students or employees\,\n\n\n\nPointers for navigating cancel culture when it targets faculty or staff\, and\n\n\n\nPros and cons of institutional responses to disputes playing out on social media\, including considerations of reputational risk.\n\n\n\n\nWho should attend?  \n\n\n\nThis webinar will be of interest to lawyers employed by colleges and universities within the Office of General Counsel and in various roles throughout the institution\, outside counsel\, and senior institutional leaders. fficers and administrators\, and major gifts officers\, will also find this webinar valuable. \n\n\n\n\n\nSpeakers\n\n\n\n\n\n\n\n\n\n\nProgram Schedule\n\n\n\nTimeSession Topic12 :00 P.M.
