SUMMARY:You Signed What?! Delegated Contractual Authority – Best Practices and Policies
DESCRIPTION:Briefing\n\nStop Campus Hazing Act: What You Need to Know to Comply\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nAt any given moment\, colleges and universities manage hundreds\, if not thousands\, of contracts reaching all areas of campus operations. Depending on an institution’s size\, it can be nearly impossible for campus counsel to review every contract. Therefore\, officers and employees on campus are often granted delegated signature authority to enter into contracts on behalf of the institution. \n\n\n\nPlease join us for a 2-hour webinar where two expert NACUA member attorneys will discuss delegated contractual authority\, including:  \n\n\n\n\nDiscussion on best practices for implementing a contractual authority policy or process\, including tips and samples for creating a delegated contractual authority matrix;\n\n\n\nDistinctions between campus counsel’s role vs. the role of institutional business partners; \n\n\n\nLitigation issues\, including those related to personal liability;\n\n\n\nCaselaw for both public and private institutions;\n\n\n\nIssues pertaining to certain types of contracts\, such as clickthrough agreements.\n\n\n\n\nWho should attend? \n\n\n\nThis webinar will be of interest to in-house and outside counsel to colleges and universities\, as well as other higher education administrators who draft or approve contracts. \n\n\n\n\n\nSpeakers\n\n\n \n \n \n \n Guilherme Costa\n \n \n \n \n \n \n \n \n \n Guilherme Costa\n Vice President\, General Counsel and Secretary of the Corporation \n Bentley University \n Member\, 2025-2028 \n \n \n \n \nGuilherme M. SUMMARY:Colleges and Universities as Commercial Landlords: Considerations for the Generalist
DESCRIPTION:Briefing\n\nStop Campus Hazing Act: What You Need to Know to Comply\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nMany\, perhaps most\, colleges and universities are also landlords—not only to students in residence halls but also to a variety of commercial interests ranging from small\, local “mom and pop” shops to large\, brand-name corporate franchises. At the same time\, real estate law is a world unto itself with its own language and practices. While some large institutions may have real estate experts in their legal departments\, many institutions have one or two generalists who also handle leasing from time to time. \n\n\n\nJoin us for a 90-minute webinar in which two expert NACUA member attorneys and a campus Director of Real Estate Planning will discuss the role of campuses as landlords in the commercial leasing context\, including: \n\n\n\n\nPre-planning considerations to think about before beginning negotiations with a potential tenant;\n\n\n\nPost-execution communications and lease management;\n\n\n\nWhat to include in a well-crafted letter of intent;\n\n\n\nCoordination with other departments on campus;\n\n\n\nLease provisions of particular concern in the higher education context;\n\n\n\nTerms to pay particular attention to\, and more.  \n\n\n\n\nWho Should Attend? This is an introductory-level webinar which will be of particular interest to counsel who are new to higher education law or new to real-estate work. \n\n\n\n\n\nSpeakers\n\n\n \n \n \n \n Guilherme Costa\n \n \n \n \n \n \n \n \n \n Guilherme Costa\n Vice President\, General Counsel and Secretary of the Corporation \n Bentley University \n Member\, 2025-2028 \n \n \n \n \nGuilherme M. SUMMARY:Yes We Can: Approaches to Post-Tenure Faculty Review
DESCRIPTION:Briefing\n\nStop Campus Hazing Act: What You Need to Know to Comply\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nThe vast majority of tenured faculty members offer vital contributions throughout their careers to advance the teaching and research missions of their colleges and universities.  However\, addressing the performance and conduct issues posed by a small number of tenured faculty in a shared governance framework often requires a large-scale coordinated effort on the part of counsel\, provosts\, department chairs\, and a cadre of other institutional leaders.  The result is usually limited success in minimizing the legal and reputational risks posed by an underperforming or misbehaving faculty member – or worse— messy and public complaints\, litigation\, and internal cultural strife.  \n\n\n\nJoin us for a 90-minute webinar in which two expert NACUA member attorneys will discuss post-tenure faculty review\, including:  \n\n\n\n\n Legal developments over time that have impacted the institution of tenure that have both contributed to the challenge of problematic tenured faculty members and recently provided an opportunity to address this issue;\n\n\n\nCosts and benefits of instituting a post-tenure review policy or system that balances risk mitigation\, due process\, and respect for academic freedom;\n\n\n\nPractical considerations such as building internal stakeholder support;\n\n\n\nAnd employment legal implications including conducting defensible reviews\, unionized faculty\, and more. \n\n\n\n\nWho Should Attend?  \n\n\n\nThis webinar will be of particular interest to counsel who advise on faculty matters\, academic affairs\, employment law\, and institutional policy development and management\, as well as institutional colleagues in the Offices of the Provost\, Faculty Affairs\, and Academic Affairs. \n\n\n\n\n\nSpeakers\n\n\n \n \n \n \n Guilherme Costa\n \n \n \n \n \n \n \n \n \n Guilherme Costa\n Vice President\, General Counsel and Secretary of the Corporation \n Bentley University \n Member\, 2025-2028 \n \n \n \n \nGuilherme M. SUMMARY:At The Top of Your Feed:  Social Media Issues on Campus
DESCRIPTION:Briefing\n\nStop Campus Hazing Act: What You Need to Know to Comply\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nStudents\, faculty\, and staff have long used social media to engage with one another and with the world outside of the institution. However\, the expanding reach and evolution of social media platforms has challenged the law – and campus counsel – to keep pace. One post can unleash severe ideological clashes among faculty\, students\, and the community in a contentious political climate. A new reel can give rise to an entire workstream focused on student-athletes’ ability to use social media for commercial purposes. A five-word Tweet can lead to a five-month legal saga with the growing world of influencers providing social media commentary as the institution grapples with sensitive issues. These are just some of the complex situations arising from social media at colleges and universities. Join us for this 2-hour webinar where presenters will explore legal developments related to social media issues\, including:  \n\n\n\n\nAdvice for developing and revising social media policies\,\n\n\n\nUpdates on recent case law in the social media space\, including guidance on distinguishing “on-campus” from “off-campus” speech and on addressing and/or disciplining social media behavior by students or employees\,\n\n\n\nPointers for navigating cancel culture when it targets faculty or staff\, and\n\n\n\nPros and cons of institutional responses to disputes playing out on social media\, including considerations of reputational risk.\n\n\n\n\nWho should attend?  \n\n\n\nThis webinar will be of interest to lawyers employed by colleges and universities within the Office of General Counsel and in various roles throughout the institution\, outside counsel\, and senior institutional leaders. fficers and administrators\, and major gifts officers\, will also find this webinar valuable. \n\n\n\n\n\nSpeakers\n\n\n \n \n \n \n Guilherme Costa\n \n \n \n \n \n \n \n \n \n Guilherme Costa\n Vice President\, General Counsel and Secretary of the Corporation \n Bentley University \n Member\, 2025-2028 \n \n \n \n \nGuilherme M.
