And while there is no “app for that\,” there is an innovative pre-Workshop to NACUA’s 2025 Virtual Winter Workshop on AI! SUMMARY:What Now? Title IX in the Aftermath of Tennessee v. Cardona

On January 9\, 2025\, the U.S District Court for the Eastern District of Kentucky issued its decision in Tennessee v. Cardona\, granting summary judgment in favor of the plaintiff states of Kentucky\, Virginia\, Indiana\, Tennessee\, and West Virginia\, and vacating the 2024 Final Rule. The Court found that that U.S. Department of Education exceeded its authority in implementing the regulations and that the Final Rule and its corresponding regulations also violate the U.S. Constitution. Although the primary thrust of the challenge was to the inclusion of “gender identity” as a protected category within sex-based harassment\, the decision impacts additional changes brought about by the Final Rule including those pertaining to handling grievances\, training\, recordkeeping\, processing complaints\, as well as the extended protections for pregnancy and related conditions.   \n\n\n\nPlease join us for a 30-minute briefing during which NACUA member-experts will provide an overview of Tennessee v. SUMMARY:Stop Campus Hazing Act: What You Need to Know to Comply

Biden\, Jr. signed the Stop Campus Hazing Act (the “Act”) into law on December 23\, 2024\, to address concerns about injuries and deaths on college campuses related to hazing activities. The Act\, which amends the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act\, imposes several requirements on colleges and universities\, many of which already became\, or will soon become effective. This Rule establishes detailed technical standards for web and mobile app content accessibility to promote equitable access to public services for people with a range of disabilities. PWFA requires covered employers to provide reasonable accommodations for an employee’s known limitations correlated with pregnancy\, childbirth\, or related medical conditions\, unless doing so will cause the employer an undue hardship; while the PUMP Act expands workplace protections for lactating employees and requires employers to provide reasonable break time and private space for personnel to express milk while at work. As anticipated\, the Final Rule makes several significant departures from the 2020 Rule\, by expanding Title IX’s scope\, including expanding the definition of sex-based discrimination and harassment\, and broadening what triggers an institutional response obligation\, among other things. At the same time\, the Final Rule introduces a level of institutional discretion not present in the current regulations. \n\n\n\nPlease join us for this 2-hour webinar\, in which our member experts will provide an in-depth exploration of the Title IX Final Rule\, unveiling its expanded scope and implications. As anticipated\, this Rule reverses several changes made by the Trump Administration\, which took effect in 2020\, by “provid[ing] greater clarity regarding the definition of ‘sex-based harassment;’ the scope of sex discrimination\, including recipients’ obligations not to discriminate based on sex stereotypes\, sex characteristics\, pregnancy or related conditions\, sexual orientation\, and gender identity; and recipients’ obligations to provide an educational environment free from discrimination on the basis of sex.”   \n\n\n\nIn this 30-minute\, audio-only briefing\, NACUA members\, Patty Petrowski (University of Michigan)\, Bindu Jayne (Swarthmore College)\, and Josh Richards (Saul Ewing LLP)\, will offer a brief overview of the final regulations and highlight some of the most significant areas of departure from existing regulations. Depending on an institution’s size\, it can be nearly impossible for campus counsel to review every contract. In that capacity her primary obligations are to the flagship University and the three affiliate campuses in western Montana. UM's Office of Legal Counsel is only a two person team\, and Kate practices in all areas of higher ed law. Kate joined UM in Fall 2019.   \n\n\n\nPrior to coming to UM\, Kate worked as a Deputy Attorney General (DAG) for the Office of the New Jersey Attorney General for 7 years. As a DAG\, she represented New Jersey’s state institutions of higher education in all sorts of litigation and administrative matters\, from employment to contract disputes. Kate also was part of the Open Public Records Act team where she defended the state in numerous matters regarding alleged failures to disclose public records and follow open meeting laws. Prior to her work at the N.J. At the same time\, real estate law is a world unto itself with its own language and practices.
