DESCRIPTION:Webinar\n\nDisability Accommodations: DEIA\, Technical Standards\, and Beyond\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nWith declining enrollments and an increasingly complex business and regulatory environment\, higher education faces an era of institutional consolidations.  Yet\, just as institutions need to become more agile\, the Department of Education’s recent rulemaking on changes in ownership has added new layers of expense and risk to the already entangled merger process.  The Department now requires a two-step process whereby the completed change in ownership must receive state authorization\, accreditor approval\, and Department approval before it will issue a final Provisional Program Participation Agreement to receive Title IV funding.  Transactions that are not well positioned to meet these requirements and timed strategically may be at risk of failing. As anticipated\, this Rule reverses several changes made by the Trump Administration\, which took effect in 2020\, by “provid[ing] greater clarity regarding the definition of ‘sex-based harassment;’ the scope of sex discrimination\, including recipients’ obligations not to discriminate based on sex stereotypes\, sex characteristics\, pregnancy or related conditions\, sexual orientation\, and gender identity; and recipients’ obligations to provide an educational environment free from discrimination on the basis of sex.”   \n\n\n\nIn this 30-minute\, audio-only briefing\, NACUA members\, Patty Petrowski (University of Michigan)\, Bindu Jayne (Swarthmore College)\, and Josh Richards (Saul Ewing LLP)\, will offer a brief overview of the final regulations and highlight some of the most significant areas of departure from existing regulations. DESCRIPTION:Webinar\n\nDisability Accommodations: DEIA\, Technical Standards\, and Beyond\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nOn September 28\, 2023\, the U.S. Department of Education\, Office of Postsecondary Education\, published a new Final Rule governing Gainful Employment programs and\, separately\, a new Financial Value Transparency Framework that would apply to “nearly all academic programs at postsecondary institutions.” The Department will establish performance benchmarks for each program based on information institutions will be required to report and earnings data to be provided by a federal agency. UM's Office of Legal Counsel is only a two person team\, and Kate practices in all areas of higher ed law. Kate joined UM in Fall 2019.   \n\n\n\nPrior to coming to UM\, Kate worked as a Deputy Attorney General (DAG) for the Office of the New Jersey Attorney General for 7 years. As a DAG\, she represented New Jersey’s state institutions of higher education in all sorts of litigation and administrative matters\, from employment to contract disputes. Kate also was part of the Open Public Records Act team where she defended the state in numerous matters regarding alleged failures to disclose public records and follow open meeting laws. Prior to her work at the N.J. A new reel can give rise to an entire workstream focused on student-athletes’ ability to use social media for commercial purposes. A five-word Tweet can lead to a five-month legal saga with the growing world of influencers providing social media commentary as the institution grapples with sensitive issues. These are just some of the complex situations arising from social media at colleges and universities. Richards has been part the Office of the Vice President and General Counsel at the George Washington University since 2003\, starting as a law clerk and working her way through the ranks to her present Senior Counsel role. She regularly advises senior leaders on a wide range of issues impacting higher education. Her principal areas of focus include non-profit governance and compliance\, business and banking transactions\, non-profit taxation\, international issues\, conflicts of interest\, research compliance\, and general contract review. In addition\, for several years she taught a course in Higher Education Law and Politics at Drexel University’s Graduate School of Education.    \n\n\n\nAbbey joined NACUA in 2005. During this time\, she has served on several committees including multi-year terms on the Committee on Finance and Audit\, the Committee on Strategic Planning\, the Committee on Membership and Member Services\, and the Committee on Program for Annual Conference. She has also spoken several times at NACUA conferences and workshops.   \n\n\n\nAbbey holds a B.A. in International and Area Studies from the University of Oklahoma and both a J.D. and an M.A. in International Affairs from the George Washington University.
