PWFA requires covered employers to provide reasonable accommodations for an employee’s known limitations correlated with pregnancy\, childbirth\, or related medical conditions\, unless doing so will cause the employer an undue hardship; while the PUMP Act expands workplace protections for lactating employees and requires employers to provide reasonable break time and private space for personnel to express milk while at work. As anticipated\, the Final Rule makes several significant departures from the 2020 Rule\, by expanding Title IX’s scope\, including expanding the definition of sex-based discrimination and harassment\, and broadening what triggers an institutional response obligation\, among other things. At the same time\, the Final Rule introduces a level of institutional discretion not present in the current regulations. \n\n\n\nPlease join us for this 2-hour webinar\, in which our member experts will provide an in-depth exploration of the Title IX Final Rule\, unveiling its expanded scope and implications. From the evolving landscape of gender equity in higher education to crucial compliance strategies\, this webinar will equip you with the knowledge to navigate confidently in the new era of Title IX enforcement. SUMMARY:M&A or Closure? Complex Considerations\, Critical Choices
DESCRIPTION:Webinar\n\nThe Law of Gender Identity on Campus\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nWith declining enrollments and an increasingly complex business and regulatory environment\, higher education faces an era of institutional consolidations.  Yet\, just as institutions need to become more agile\, the Department of Education’s recent rulemaking on changes in ownership has added new layers of expense and risk to the already entangled merger process.  The Department now requires a two-step process whereby the completed change in ownership must receive state authorization\, accreditor approval\, and Department approval before it will issue a final Provisional Program Participation Agreement to receive Title IV funding.  Transactions that are not well positioned to meet these requirements and timed strategically may be at risk of failing. SUMMARY:The Financial Value Transparency Wake-Up Call: Navigating a New Compliance and Business Landscape
DESCRIPTION:Webinar\n\nThe Law of Gender Identity on Campus\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nOn September 28\, 2023\, the U.S. Department of Education\, Office of Postsecondary Education\, published a new Final Rule governing Gainful Employment programs and\, separately\, a new Financial Value Transparency Framework that would apply to “nearly all academic programs at postsecondary institutions.” The Department will establish performance benchmarks for each program based on information institutions will be required to report and earnings data to be provided by a federal agency. As Chief Legal Officer\, she leads the Office of the General Counsel\, consisting of a team of attorneys focused on strategic and preventive advising\, finding innovative solutions\, and fostering collaborative problem-solving. Reporting directly to the President\, Becca is a member of the University Cabinet and advises the Board of Trustees\, President\, Provost\, and various levels of university leadership. \n\n\n\nBecca has served OSU since 2010\, as Assistant and then Associate General Counsel\, and began her role as Chief Legal Officer in 2015. Prior to joining OSU\, she was an associate litigation attorney in the San Francisco office of Munger\, Tolles and Olson\, where a portion of her practice was dedicated to representing higher education institutions. She received her JD from the University of California at Berkeley and her BA from the University of Colorado at Boulder. Following law school\, she clerked for the Honorable David M. Ebel on the Tenth Circuit Court of Appeals. \n\n\n\nBecca actively contributes to the higher-education legal community through her involvement in NACUA and is currently serving on the Board of Directors and chairs the Committee on Strategic Planning. Her prior engagements include participation on the Annual Conference Planning Committee\, Committee on Legal Education\, General Counsel Institute Planning Committee\, and the NACUA Membership and New Members Committee. She has also been a speaker or a discussion leader at multiple NACUA conferences and workshops. In this role\, Esther primarily works on student affairs\, faculty affairs\, and employment matters.   \n\n\n\nPreviously\, Esther served as Senior Associate General Counsel in the Office of the General Counsel of Oregon State University (Corvallis) from June 2015 to May 2022.  Esther supervised four attorneys and primarily practiced within student\, employment\, Title IX and sexual misconduct\, compliance and emergency response areas.  In this role\, Esther also advised the Threat Assessment Team\, Clery Timely Warning response group\, and Student Care Team. \n\n\n\nPrior to OSU\, Esther served at the Colorado School of Mines (Golden\, CO) as Associate Counsel from October 2006 through June 2015\, where she was a true generalist in a two-attorney office.   \n\n\n\nFrom September 2002 through October 2006\, Esther was the HIPAA Project Manager and Privacy Officer for the University of Colorado Health Sciences Center (now the Anschutz Medical Campus) in Denver and Aurora.  In this role\, she was responsible for implementing HIPAA compliance\, delivering employee training\, and responding to privacy-related allegations and requests. \n\n\n\nEsther began her higher education practice at the University of Colorado Health Sciences Center Office of General Counsel in September 2000.  She was a Research Associate Attorney in that role and primarily advised related to the campus' health professions academic programs\, public records\, compliance and student matters. \n\n\n\nEsther holds a Bachelor of Arts in Spanish and a Bachelor of Science in Management from Purdue University (West Lafayette).  She received her J.D. from Indiana University (Bloomington) - Maurer School of Law. \n                                    \n            \n                    \n                                    \n                                            \n                                Daniel A. A new reel can give rise to an entire workstream focused on student-athletes’ ability to use social media for commercial purposes. A five-word Tweet can lead to a five-month legal saga with the growing world of influencers providing social media commentary as the institution grapples with sensitive issues. These are just some of the complex situations arising from social media at colleges and universities.
