As the regulatory environment evolves\, counsel must contend with less predictability\, as well as a much wider range of authority\, statutory interpretations\, enforcement priorities\, and operating approaches. The result is greater uncertainty for institutions and increasingly complex considerations for college and university attorneys. SUMMARY:Title IX\, One Year Later
DESCRIPTION:Webinar\n\nNavigating Title VI in 2026: Practical Guidance for Higher Education\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nTitle IX remains a socio-political and legal football.   \n\n\n\nOn April 19\, 2024\, the U.S. Department of Education\, Office for Civil Rights (the Department)\, released its 2024 Title IX regulations\, which included significant departures from the 2020 Rule\, including expanding the definition of sex-based discrimination and harassment\, and broadening what triggers an institutional response obligation. It also introduced a level of institutional discretion absent in the 2020 Final Rule.   \n\n\n\nLitigation ensued\, challenging various aspects of the 2024 Final Rule\, in particular the inclusion of “gender identity” as a protected category within sex-based harassment. On January 9\, 2025\, the U.S District Court for the Eastern District of Kentucky issued its decision in Tennessee v. Cardona\, vacating the 2024 Final Rule by ruling that that the Department exceeded its authority in implementing the regulations and that the 2024 Final Rule and its corresponding regulations also violated the U.S. Constitution.   \n\n\n\nNine days later\, Donald J. Trump was sworn in as the 47th President of the United States\, and thereafter the Department issued a new Dear Colleague Letter announcing its intention to enforce the 2020 Final Rule. In the weeks since\, the Department has made enforcement of a narrow definition of gender in both investigations and athletics participation a keystone priority\, most recently announcing an interagency task force toward that end.   \n\n\n\nPlease join NACUA for a 2-hour webinar\, in which our member experts will provide an in-depth exploration of the rapid transformation of Title IX over the last twelve months. PWFA requires covered employers to provide reasonable accommodations for an employee’s known limitations correlated with pregnancy\, childbirth\, or related medical conditions\, unless doing so will cause the employer an undue hardship; while the PUMP Act expands workplace protections for lactating employees and requires employers to provide reasonable break time and private space for personnel to express milk while at work. DESCRIPTION:Webinar\n\nNavigating Title VI in 2026: Practical Guidance for Higher Education\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nWith declining enrollments and an increasingly complex business and regulatory environment\, higher education faces an era of institutional consolidations.  Yet\, just as institutions need to become more agile\, the Department of Education’s recent rulemaking on changes in ownership has added new layers of expense and risk to the already entangled merger process.  The Department now requires a two-step process whereby the completed change in ownership must receive state authorization\, accreditor approval\, and Department approval before it will issue a final Provisional Program Participation Agreement to receive Title IV funding.  Transactions that are not well positioned to meet these requirements and timed strategically may be at risk of failing. DESCRIPTION:Webinar\n\nNavigating Title VI in 2026: Practical Guidance for Higher Education\n\n\n\n\n\n\n\n\n\nEvent Details\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nAbout this Event\n\n\n\nOn September 28\, 2023\, the U.S. Department of Education\, Office of Postsecondary Education\, published a new Final Rule governing Gainful Employment programs and\, separately\, a new Financial Value Transparency Framework that would apply to “nearly all academic programs at postsecondary institutions.” The Department will establish performance benchmarks for each program based on information institutions will be required to report and earnings data to be provided by a federal agency. Ms. Frey holds a BA in History from Northwestern University and a JD from American University\, Washington College of Law.  \n                                    \n            \n                    \n                                    \n                                            \n                                Tami Strickman\n            \n            \n                \n                        \n                    \n                \n                                            \n                                                    \n                                        \n                        Tami Strickman\n                        Special Advisor to the President and Executive Director \n                                                    University of Michigan \n                                                                    \n                \n                \n                                            \nTami Strickman serves as Special Advisor to the President and Executive Director of the University of Michigan’s Equity\, Civil Rights and Title IX Office.   \n\n\n\nIn this leadership role\, she focuses on advancing a campus environment free of discrimination and harassment through policy\, educational programs and organizational structures that are trauma-informed and in accordance with federal laws and regulations.   \n\n\n\nSince joining U-M in 2020\, she has increased institutional resources focused on prevention and response\, served on a variety of campus committees and created key alliances with the Flint and Dearborn campuses to address misconduct across the institution.  \n\n\n\nShe has more than a decade of experience in matters involving allegations of discrimination under Title VI and VII of the Civil Rights Act of 1964\, the Americans with Disabilities Act and Title IX of the Education Amendments Act of 1972. In 2016\, she founded an alliance of Title IX administrators within the Big Ten Conference where members continue to connect and discuss issues\, practices and policies related to Title IX.  \n\n\n\nPrior to joining U-M\, Strickman served as associate to the chancellor for institutional equity and Title IX coordinator at the University of Nebraska-Lincoln and was a prosecutor in Chicago for 14 years.  \n                                    \n            \n            \n\n\n\n\n\n\n\n\nProgram Schedule\n\n\n\nTimeSession Topic12:00 P.M.
